• Contact Information: Phone number, email address, and emergency contact/co-maker details.
• Financial & Livelihood Data: Source of income, farming/business details, monthly income, bank account details, share capital balances, and credit history.
• Loan Transaction Data: Loan amounts requested, purposes of the loan, payment schedules, outstanding balances, repayment history, and collateral details.

2. How We Use Your Information

We use the collected information strictly for legitimate cooperative operations, specifically to:

• Evaluate and process loan applications.
• Monitor loan accounts, track repayment schedules, and update balances within the LMS.
• Send automated or manual payment reminders, receipts, and account statements via SMS, email, or mail.
• Assess credit risk and prevent fraud or non-payment.
• Comply with legal, regulatory, and audit requirements set by the Cooperative Development Authority (CDA) and other governing bodies.

3. Data Sharing and Disclosure

AANEMPC does not sell, rent, or trade your personal information to third parties. We only share your data under the following strict conditions:

• With Your Consent: To co-makers, guarantors, or credit bureaus as authorized by your loan agreement.
• Service Providers: Trusted IT developers or cloud hosting providers who maintain our Loan Monitoring System, bound by strict confidentiality agreements.
• Legal Obligations: When required by law, court orders, or regulators (e.g., Credit Information Corporation, CDA, or tax authorities).

4. Data Security & Storage

We implement robust technical, organizational, and physical security measures to protect your data within the Loan Monitoring System:

• Encryption: Sensitive financial data and passwords are encrypted during transmission and storage.
• Access Control: Only authorized credit committee members and cooperative staff have access to the LMS, managed via secure login credentials.
• Retention: We retain your loan records only for as long as necessary to fulfill the purposes outlined in this policy or to comply with statutory legal retention periods.

5. Your Rights as a Data Subject

As a member of AANEMPC, you hold the following rights regarding your data:

• Right to Access: You can request a summary of your loan status and personal data stored in the LMS.
• Right to Rectification: You have the right to correct any inaccurate or outdated information in your profile.
• Right to Object/Erasure: You may object to certain data processing activities, provided it does not conflict with active, unliquidated loan obligations or legal requirements.

Welcome to the Loan Monitoring System ("LMS" or "System"), owned and operated by Aating Ani Multipurpose Cooperative (AANEMPC). By applying for a loan, accessing the system portal, or using our credit services, you ("Member," "Borrower," or "User") agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. Eligibility & Account Registration

• Cooperative Membership: Only active and good-standing members of AANEMPC who meet the criteria set by the Credit Committee are eligible to apply for loans through the System.
• Account Security: Users are responsible for maintaining the confidentiality of their system login credentials (usernames, passwords, or PINs). Any transaction or loan application initiated through your account will be deemed executed by you.
• Accurate Information: You agree to provide true, accurate, and complete information during loan registration. Providing false details constitutes a breach of these terms and may result in immediate loan denial or membership suspension.

2. Loan Evaluation, Approval, and Disbursement

• System Discretion: Submission of a loan application via the LMS does not guarantee approval. All loans are subject to credit evaluation, evaluation of share capital, and final vetting by the AANEMPC Credit Committee.
• Disbursement Methods: Approved loans will be credited to the member's cooperative savings account, bank account, or disbursed via check/cash as specified in the application.

3. Interest Rates, Fees, and Repayments

• Rates and Charges: Interest rates, service fees, and documentary stamp taxes will be applied based on the specific loan product type (e.g., Agricultural, Emergency, Microfinance) as approved by the Board of Directors.
• Payment Obligations: The Borrower promises to pay AANEMPC the principal amount along with interest and fees according to the amortization schedule generated by the LMS.
• Late Payment Penalties: Failure to pay any installment on or before the due date will automatically incur a penalty fee (e.g., 2% per month or as dictated by cooperative policy) calculated on the overdue amount.

4. Collateral and Co-Makers (Guarantors)

• Security: If a loan requires collateral (e.g., land title, equipment, or crops), AANEMPC reserves the right to encumber or foreclose on the property in the event of default.
• Co-Maker Liability: Co-makers signed onto a loan are jointly and severally liable, meaning they are equally responsible for paying off the full balance if the primary borrower defaults.

5. Default and Remedies

A borrower is considered in Default if they fail to pay installments for consecutive periods, violate any provision of these terms, or if the cooperative discovers fraudulent data. In case of default, AANEMPC reserves the right to:

• Declare the entire outstanding loan balance immediately due and payable.
• Automatically offset the balance using the member's Share Capital or Savings Deposits held by AANEMPC.
• Initiate legal collection proceedings. The borrower shall shoulder all legal fees, collection costs, and attorney expenses.

6. System Prohibitions and Intellectual Property

• System Integrity: Users must not attempt to hack, disrupt, modify, or inject malicious code into the LMS.
• Ownership: The software, database architecture, user interface design, and logos associated with the LMS are the exclusive intellectual property of AANEMPC or its system developer.

7. Limitation of Liability

While AANEMPC strives to ensure 24/7 uptime for the online or digital tracking portals, we are not liable for any temporary service disruptions, data delays caused by telecommunication failures, or processing delays due to natural disasters (force majeure).

8. Amendments to Terms

AANEMPC reserves the right to modify these Terms and Conditions at any time to align with new policies or regulatory updates from the Cooperative Development Authority (CDA). Continued use of the loan facilities after changes are posted constitutes acceptance of the updated terms.

9. Governing Law

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the cooperative laws of the Philippines. Any legal disputes arising from this system shall be settled exclusively in the proper courts of the city/municipality where AANEMPC's main office is located.
